What happens to my will if I later divorce?
Section 123.001(b) of the Texas Estates Code states that if a testator divorces, the entire Will is read as though the former spouse and relatives of the former spouse, who are not relatives of the testator, predeceased (died before) the testator.
Although writing and executing a new will is not legally required, our office recommends that a new will to avoid any confusion.
