What is mediation?
In Texas, when the parties to a case do not agree to the terms of the divorce agreement, the court will require that the parties attend mediation before scheduling a trial.
The purpose of mediation is to avoid trial. During mediation, the parties and their respective attorneys meet with a neutral third party, who is usually another attorney. The third-party attorney’s job is to help the parties reach a mutually satisfactory settlement of their issues.
If mediation is not successful, the parties will lose their ability to decide how their property should be divided; and the power to decide how the property is divided will go to a family law judge.
